Upon Senate passage of the updated Foreign Intelligence Surveillance Act (FISA), Representative Russ Feingold (D- Wisconsin) commented that passage of this bill was an assault upon our Constitution and its darkest hour. Rep. Feingold was directing these comments to the bill’s provision of immunity from lawsuits for telecom companies that cooperated with President Bush’s illegal spying on overseas communications by American citizens. While at first glance Congressman Feingold’s comments are a refreshing breath of fresh air which we rarely get from our national leaders, upon analysis, he was remiss in not describing the depth and true nature of the assault he was talking about. Furthermore, although this current assault was horrific, it was not as damaging as other assaults on our Constitution which have occurred in the past which are never talked about by politicians of today. From these perspectives, it is reasonable to wonder if Senator Feingold is not really concerned about the violation of our Constitution, but instead, made his comments solely to create the illusion that he and other Congressmen are.

The original FISA was passed in 1978 following Watergate the spying scandals which occurred during that decade. Its purpose was to ensure that the President would never again unilaterally spy upon the communications of Americans. Following 9/11, President Bush saw this act as an inconvenience to his war on terrorism so he ignored the act and enlisted several telecom companies to assist him in spying upon American overseas communications. President Bush knowingly and deliberately broke the law and to induce telecom executives to cooperate with his illegal program he gave them written assurances that the spying was legal. With these bogus assurances in hand, these executives also willingly and knowingly broke the law to gain favor with the Whitehouse, because they feared possible future reprisals, and/or out of misplaced patriotism. Lending credence to the first two conclusions is that fact that Qwest CEO Joseph P. Nacchio declined to participate in President Bush’s illegal spying program and subsequently, his company lost several lucrative government contracts and he presently is facing charges of insider trading.

All of the forgoing being a true and accurate description of the situation, 69 out of the 96 voting Senators thought that, under the circumstances, offending telecom executives deserved to be granted immunity from the 46 lawsuits filed by citizens seeking redress in the matter. The Whitehouse argued that immunity should be granted because the Executives in question were given assurances that the illegal spying was legal and because punishing the executives would dissuade their cooperation with the Whitehouse in the future. Some Senators also postured that although the telecom executives knowingly broke the law, they did so out of patriotic duty and this mitigated their actions. While some people will see an element of cogency in these arguments, in the final analysis, they pale in comparison to the horrific fact that the rights of Americans were deliberately and grievously violated by President Bush in consort with the offending telecom industry executives and now Congress has denied these citizens redress in the matter. There are many things that can be said about this development, but the most telling is that, apparently, members of Congress care more about their relationship with the offending telecom executives than they do with the citizens who pay their salary. Adding insult to injury, although the granting of immunity does not extend to criminal prosecution of the participating telecom executives, the chance of this ever happening is now nil to none. The agency responsible for filing such charges is the Department of Justice and unfortunately for justice, the Department of Justice reports and answers directly to George Bush, the person who orchestrated these felonious criminal acts in the first place.

Congress took it upon itself to grant immunity to the offending telecom executives in an official piece of legislation President Bush will sign this legislation. This development is a tragedy for this Nation because in a legal sense, the immunity being granted is unprecedented, unjustifiable, and contrary to the principles that underpin our criminal justices system. In the past, immunity was granted to induce a minor participant in a crime to testify against the principles who were instrumental in perpetuating a crime. Therefore, the granting of immunity is a form of bartering the purpose of which is to use the little fish to capture the big fish. The immunity granted by Congress to the telecom executives in question by way of legislation is nothing like this. Instead it is a blanket immunity granted for the sole purpose of letting the guilty parties off the hook when we do not know specifically who they are, the extent of their crimes, or their level of guilt. Granting immunity under these circumstances is an absurd miscarriage of justice which makes Congress a party to the cover-up of these crimes.

Beyond a cover-up, granting blanket immunity for any reason by Congress is unconstitutional. Our Constitution clearly defines the duties and responsibilities of Congress. Amendment X of the Constitution provides that the powers not delegated to our Federal Government by the Constitution, are reserved to the States or the people. In other words, no branch of our federal government can assume a power not granted specifically to it by the Constitution. The power or authority to grant blanket immunity for criminal acts appears nowhere in our Constitution. Therefore, for Congress to unilaterally assume this power and let the telecom executives off the hook is unconstitutional. Furthermore, Article I, Section 9 of our Constitution provides that Congress will pass “No ex post facto” laws. “Ex post facto” means laws that are retroactive and apply to past situations. The FISA law just past by Congress provides retroactive immunity to telecom executives and is unconstitutional for this reason as well.

In Conclusion, the recently passed FISA legislation passed by Congress is unconstitutional for two reasons; its immunity provision is a power assumed by Congress that is not provided for anywhere in our Constitution and it provides after-the-fact retroactive immunity which is specifically prohibited by our Constitution. The unfortunate and dismal reality of this situation is that President Bush knows this, our Justice Department knows this, and so does all of Congress. Under these circumstances, it is time for Americans to ask why 69 United Senators willfully and deliberately violated their oath of office to pass this ignoble legislation? The obvious answers to this question are to protect the offending rich and powerful telecom executives involved and to also protect President Bush who was the perpetuator of these crimes. In other words, damn the Constitution, damn the truth, damn justice, and damn the people of this Nation. The most important thing to members of Congress is feathering their own nests by protecting the ruling establishment at all costs.

As I write, most Americans are still proud to be American and think that the United States is the greatest country in the world. They also think that anyone who does not think like them is a disloyal moron who can't be trusted and should go live somewhere else. If you don't like it here, leave! Unfortunately, things are not quite that simple because a very real possibility exists that it is the "proud Americans" who are the disloyal morons.

Let's go back in American history to the turn of the century when this nation was only 124 years old and imagine that a coup occurred and Americans living at the time suddenly awoke one morning and found that the conspirators behind the coup had published a manifesto establishing a new government that all Americans would have to swear allegiance to. This manifesto is as follows:

  • All departments and branches of the old government would remain in place and functional but the coup conspirators would retain behind the scenes dictatorial power over the actions and decisions of our government.
  • The Nation will go off the gold standard and Congress will no longer coin money and regulate its value. Instead, the dollar will be backed by nothing other than good faith and a private corporation controlled by the coup conspirators would print and control the money supply.
  • Your new government intends to dominate and control the entire world. To help finance this goal there will be a new tax on the salaries and wages of all working Americans.
  • All political parties save two will be rendered dysfunctional and Americans will vote primarily for one of two candidates in the two approved parties.
  • The powers of the executive branch will be increase dramatically and the President will be able write laws, pass judgment upon laws, and ignore laws as he deems appropriate including those within our Constitution. He will also be able to make or ignore treaties, extend or withhold human rights including inalienable rights, and declare war when he deems appropriate including pre-emptive war.
  • A sitting President, once elected, will be above the law and un-impeachable for both job-related and other crimes.
  • State governments will no longer appoint Senatorial representatives and the new centralized Federal government will retain supreme authority over the states.
  • Government employees, for the most part, will be paid better and receive far more employee benefits than their counterparts in private industry.
  • Congress will no longer draft and write laws. Instead, they will be written by representatives from the industries affected by the laws being written.
  • Congress will no longer regulate trade with foreign nations. Instead the coup conspirators will perform this function.
  • Citizens will only enjoy rights at the pleasure of the government and in no way will consideration of citizen's rights infringe upon the prerogatives of government.
  • The Supreme Court will no longer intervene or interfere with anything that government does and the courts will not allow citizens to petition the government for the redress of grievances when these grievances concern government decisions, actions, and prerogatives.
  • Citizens will no longer retain an exclusive right to their property and possessions.
  • Citizens will no longer be protected from unreasonable searches and seizures.
  • Citizens will no longer retain a right to privacy and can be spied upon without their knowledge whenever government deems appropriate.
  • The United States will no longer exist as a free and independent nation. Furthermore, its borders with Mexico and Canada will be dissolved and a common currency called the Amero will be established for the three economically united nations.

I do not think that there is American alive today who would not agree that if the coup occurred as described most Americans at the turn of the 19th century would rise up and arrest its perpetuators. Furthermore, if any American living at the time sided with the coup conspirators by agreeing that such an absurd and despotic manifesto should govern this Nation and its people, then that person would be considered a traitor in league with them enemy and dealt with accordingly; i.e. an arrest and trail followed by imprisonment and/or execution.

All of the above is a forgone conclusion, but what should also be obvious is that if you could talk to any American living at the start of the 20th century and ask them if they thought that all the provision's of the manifesto in question would eventually become operative and functional for the Nation within the next 100 years, they would say such a thing is impossible and conclude they you were daft for even entertaining such a ridiculous notion. Well, as ridiculous as this notion is, in case you haven't been paying attention, the absurd manifesto described above is the unwritten, but functional, Constitution of the United States of America and our old written Constitution, the one given to us by our Founding Fathers, has been rendered dysfunctional such that it is now nothing more than a historical curiosity which has no bearing on how our government functions and operates. Therefore, the government we live under today, beyond question, is illegal, unconstitutional, and rules without the consent of the governed, with the exception, of course, all of those who are still proud to be an American.

Many Americans living today, while they agree that most of the items in the manifesto are operational and undesirable, disagree that a coup has taken place and hold that we got to where we are today by a random accumulation of events similar to Evolution. This being the case, while our government no longer meets or adheres to many of the ideals subscribed to by our Founding Fathers, it is not the result of a coup and therefore not illegal. While it is true many Americans will take solace in this line of reasoning, they couldn't be more wrong. This Nation is where it is today, not by accident, but instead by a purposeful design that is the brainchild of a group of international traitors and criminals known as the New World Order (NWO).

Recently, David Rockefeller, a New World Order founder and principal, went public with the following statement.

"We are grateful to the Washington Post, the New York Times, Time Magazine and other great publications whose directors have attended our meetings and respected their promises of discretion for almost forty years. It would have been impossible for us to develop our plan for the world if we had been subjected to the light of publicity during those years. But now the world is more sophisticated and prepared to march towards a world government. The supra-national sovereignty of an intellectual elite and world bankers is surely preferable to the national auto-determination practiced in past centuries."

From the above words the truth is abundantly clear; a group of conspirators with the cooperation and complicity of the mainstream media of this Nation, has met in secret for the past forty years to develop a plan for the world that included the gradual dissolution of our existing government and its replacement by a puppet government loyal and beholden to them. This plan, the implementation of which began slowly, is now being rapidly finalized by George Bush and should be fully implemented by the time he leaves office. The sad and lamentable reality of our situation is that all of this will have been accomplished behind our backs without the participation of our elected representatives in Congress. In other words, the plan is being implemented without our consent, unless of course, you happen to be someone who is still proud to be an American.

Well, my fellow Americans, be advised that I am not proud to pledge allegiance to a government which no longer exists, I am not proud to be a citizen of a nation where our rights are conditional, I am not proud to live under a government established by coup without my knowledge or consent, and I am not proud that this once great nation has been subjugated by the New World Order. Therefore, I am no longer proud to be an American and furthermore, I am ashamed of my fellow Americans who still are because their stupidity gives license to what has happened to us.

In conclusion, I am a true American, patriotic to the core, who is cursed by being a minority among morons who have no idea what it means to be an American and through their ignorance now swear allegiance to tyranny.
